CLAIMSUPPORT
A product offering expert advice and protection for the shipowner, charterer or trader seeking to limit exposure to high legal costs when dealing with day-to-day problems

    WHAT WE COVER
  • Advice on a 24/365 basis in respect of any problem or claim arising after inception of this agreement
  • Review of contract wording
  • The handling of all problems and claims to the point where litigation or arbitration is commenced.
  • The costs of Arbitration brought under the LMAA Small claims procedure
  • The costs of English Solicitors appointed or approved by us where in our sole discretion further legal advice is necessary (or where a personal injury claim is involved)
  • Advice on the collection and preservation of evidence
  • Monitoring and participation on behalf of the Client in any proceedings or mediation on a global basis
  • Crisis, media and casualty response advice
  • Appointment and liaison with salvage brokers, Average Adjusters and other experts
  • Advice in connection with the preparation, formulation and submission of any claim on the Client's Hull and Machinery or Protection and Indemnity Insurers
  • A 10% discount will be given on any fees incurred by our preferred technical experts/surveyors CSL Global Limited where appointed by us
  • English Solicitors' letters of demand/letter before action
    WHAT WE DO NOT COVER
  • Fees of any third party unless appointed by
    C Support Limited
  • Court, Mediator's and Arbitrator's fees (including LMAA Small Claims appointment fee) and fees and disbursements ordinarily covered by International Group Protection and Indemnity policies, war risks and Hull and Machinery policies (ITC or equivalent)
  • The costs of defending or prosecuting any claims not subject to English law and jurisdiction
  • Costs incurred without the written approval of
    C Support Limited or as a result of failure to follow the reasonable advice of C Support Limited
  • Costs consequent on any misrepresentation, fraud or illegal act of the Client or any board member or employee
  • Adverse costs orders or the provision of security to any third party
  • Matters arising prior to the acceptance in writing by C Support Limited of a completed proposal form and payment of the agreed annual fee
  • Any costs incurred and unconnected with the operation and trade of the Client's ship(s) entered on the proposal form
  • LMAA Small Claims which in the opinion of
    C Support Limited stand little or no prospect of success and any award, judgment or order made against the client

This Coverage Document is to be read in conjunction with our Terms and Conditions and the Proposal Form; all of which are governed and construed in accordance with English Law and any dispute hereunder will be determined by a single Arbitrator whose opinion will be binding. Failing agreement the Arbitrator will be appointed by the Chairman of the London Admiralty Solicitors Group.
